I, Nevinson de Courcy Armstrong of the City of Hamilton, in the County of Wentworth, gentleman, make oath and say: First, that by Articles of Agreement made the seventeenth day of January in the year of Our Lord one thousand eight hundred and fifty nine, between William Craigie of the city of Hamilton, Gentleman, one of the Attorneys of Her Majesty's Court of Queen's Bench, and Common Pleas, and a solicitor in the high Court of Chancery for Upper Canada, and Daniel Freeman of the City of Hamilton: The said Daniel Freeman for the consideration therein mentioned, did put, place, and bind himself, Clerk to the said William Craigie, to serve him in the businefs practice and profession of an Attorney, at Law, and Solicitor in Chancery, from the day of the date of the said Articles, for the term of five years next ensuing, and fully to be completed and ended, and which said Articles were in due form of Law executed, by the said William Craigie and Daniel Freeman, on the day of the date thereof in the presence of this deponent, and that the name N.D. Armstrong set and subscribed to the said Articles as a witnefs to the due execution thereof, is the proper handwriting of this deponent.
Sworn before me at Hamilton )Articles of Agreement, indented, made, and concluded, upon the seventeenth day of January in the year of Our Lord one thousand eight hundred and fifty-nine, Between William Craigie, of the city of Hamilton, Gentleman, one of the Attorneys of Her Majesty's Courts of Queen's Bench, and Common Pleas, and a Solicitor in the Court of Chancery for Upper Canada of the one part; and Daniel Freeman, of the City of Hamilton, of the other part.
Witness, that the said Daniel Freeman, of his own free will, hath placed and bound himself and by these presents, doth place, and bind himself, Clerk to the said William Craigie, to serve him from the day of the date hereof, for and during, and until the full end and term of five years, from hence and ensuing and fully to be completed, and ended.
And the said Daniel Freeman, doth hereby for himself his heirs, executors, and administrators, covenant promise and agree to and with, the said William Craigie, his executors, administrators and assigns, that he will faithfully and diligently serve the said William Craigie, as his Clerk in the businefs, practice and employment of an Attorney at Law and Solicitor in Chancery. from the day of the date hereof, to and during, and until the full end of the said term of five years, and that the said Daniel Freeman will not at any time during such term, cancel, obliterate, spoil, destroy, waste, embezzle, squander, or make away with, any of the books, papers, writings, monies, stamps, chattels, or other property of the said William Craigie, his executors, administrators, or assigns or any of his clients, or employers which shall be deposited in his hands, or entrusted to his custody or possession, or which shall come, or be entrusted to the custody or possession of the said Daniel Freeman. And Further that the said Daniel Freeman shall and will from time to time, and, at all times during the said term, keep the secrets of the said William Craigie, and readily and cheerfully obey and execute his lawful and reasonable commands, and shall not depart nor absent himself from the service or employ of the said William Craigie at any time during the said term, without his consent first obtained; but shall from time to time, and at all times during the said term, conduct himself, with due diligence, honesty, and propriety.
And the said Daniel Freeman doth hereby covenant promise and agree to and with the said William Craigie, his executors, administrators, and assigns, that he the said Daniel Freeman, shall and will truly, honestly, and diligently serve the said William Craigie, at all times for and during the said term, as a faithful clerk ought to do in all things whatsoever, in the manner above specified.
In Consideration whereof, and of the sum of five shillings by the said Daniel Freeman to the said William Craigie in hand well and truly paid, at or before the sealing or delivery of these presents, (the receipt whereof the said William Craigie doth hereby acknowledge, and of every part thereof doth acquit, release, and disengage the said Daniel Freeman, his executors and administrators and every one of them forever by these presents).
The said William Craigie, for himself, his heirs, executors, and administrators, doth covenant, promise and agree that he shall and will accept and take the said Daniel Freeman as his clerk.
And Also that the said William Craigie shall and will by the best ways and means he may or can, and to the utmost of his skill and knowledge, teach and instruct or cause to be taught and instructed, the said Daniel Freeman in the practice or profession of an Attorney at Law and Solicitor in Chancery which he the said William Craigie now doth or shall at any time hereafter during the said term, use or practice and also shall and will at the expiration of the said term use his best means and endeavours, at the request, costs and charges of the said Daniel Freeman, to cause and procure him the said Daniel Freeman to be admitted and sworn an Attorney of Her Majesty's Courts of Queen's Bench and Common Pleas, or either of them or any other of Her Majesty's said Court's of Law or equity, provided the said Daniel Freeman, shall have well, faithfully, and diligently served his said intended Clerkship.
In witness whereof, the parties aforesaid have hereunto set their hands and seals the day and year first above mentioned.
